Compensation Eligibility: When Can You Claim?
Passengers may be eligible for compensation in the following situations: if an Air Europa flight arrives more than three hours late, if the flight is canceled with less than 14 days’ notice, or if boarding is denied due to overbooking. These circumstances are governed by Regulation (EC) No 261/2004, which applies to flights departing from or arriving in the EU, provided they are operated by a carrier based in the EU.
However, overbooking compensation is only possible when the airline is responsible for the disruption. If the disruption happened because of something beyond their control, such as severe weather, air traffic control restrictions, or airport strikes, compensation usually does not apply. Even technical issues or staffing problems may be treated as exceptions, depending on the details.
