What is the EU Regulation 261/2004?

EU Regulation 261/2004 protects the rights of air passengers travelling with EU-registered airlines or arriving in EU countries. For delays of more than three hours, you may be entitled to financial compensation, with the amount depending on the distance travelled.

You may also be entitled to compensation if your flight is cancelled or if you face issues with overbooking.

Under UK261 (retained EU Regulation 261/2004), if your flight is cancelled, the airline must offer you an alternative route and rebook you as soon as possible. If this does not suit you, you have the right to claim compensation through a refund. If you are unable to board the aircraft due to overbooking, the airline must provide compensation and assistance under UK261. The airline may also negotiate terms with you if you agree to voluntarily give up your seat. If your flight is delayed by more than three hours, you may be entitled to financial compensation under UK261, depending on the intended travel distance. You may also be entitled to the right to care, which includes refreshments, meals, and access to communication facilities.
What to Do If Your Flight Is Delayed or Cancelled

Airlines should provide at least a minimum level of assistance, including clear information about when your flight is expected to depart, as required.

  • Collect documents

Make sure to keep all flight-related information, including booking details, boarding passes, receipts, and any communication with the airline, as required when claiming.

Frequently Asked Questions

  • Can I claim compensation for flights affected by strikes?

While delays caused by strikes do occur quite often, it’s not always possible to claim compensation under UK261. You can only make a claim if the strike involves the airline’s own staff rather than airport employees. Even then, it can be more challenging to secure compensation.

  • How long does the compensation claim process take?

If there are no disputes and the airline accepts responsibility, the process usually takes up to eight weeks. In other cases, the claim may take several months, for example if additional documentation or clarification is required for international flights

  • What if the airline rejects my compensation claim?

If the airline rejects your claim, you can contact Skycop to receive professional assistance and additional support with your case. In many situations, rejected claims can be successfully challenged
