What Is ANAC 400?
ANAC 400 is a regulation established by Brazil’s National Civil Aviation Agency (ANAC) to protect air passengers. It sets out passenger rights in Brazil when flights are delayed, cancelled or overbooked. The regulation ensures that passengers on both domestic and international flights receive fair treatment when airlines fail to provide an adequate service. However, some of these protections only apply when certain conditions are met.
History and the Regulation
The regulation was introduced in 2016 to provide clearer guidelines on flight compensation. Before ANAC 400, airline policies were inconsistent, and passengers often struggled to receive fair treatment. In addition, airlines could introduce policies that were generally disadvantageous to customers.
The rules now apply to all flights departing from or arriving in Brazil, offering protection to millions of travellers.
Importance for Travelers
For both domestic and international flights, ANAC 400 ensures that passengers are compensated for flight delays, denied boarding or cancelled flights.
If you experience problems with your flight, understanding ANAC 400 can help you recover what you are owed.
Your Flight Was Disrupted?
Tiers of Compensation
| Aspect | Reason | Flight compensation |
|---|---|---|
| Domestic flight | 4‑hour delay or denied boarding | Up to £1,300 (approximately) |
| International flight | 4‑hour delay or denied boarding | Up to £1,300 (approximately) |
| Moral damages | 4‑hour delay with no care provided | Depends on the amount spent on necessities |
| Material damages | Delay of 1 hour or more (depending on the type of expense incurred) and failure to provide care | Depends on the amount spent on necessities |
Passenger Rights Under ANAC 400
Under ANAC 400, passengers have clear rights when dealing with flight disruptions. Airlines must provide assistance and compensation depending on the length of the delay or whether an alternative flight is available.
-
Flight delays/
If a flight delay exceeds 1 hour, airlines must provide access to communication. After 2 hours, they must offer food and drinks, or vouchers of equivalent value. After 4 hours, you are entitled to a refund, an alternative flight, or hotel accommodation if an overnight stay is required. -
Flight cancellations
If a flight is cancelled, passengers can choose between a refund, rescheduling, or rebooking on another airline. The airline must offer these options, and if it fails to do so, you may be entitled to claim flight compensation. -
Denied boarding
In cases of overbooked flights where no volunteers come forward to give up their seats, affected passengers must receive compensation and be offered an alternative flight as soon as possible. -
Baggage issues
If baggage is lost, delayed or damaged, passengers can submit a claim for reimbursement. The amount of compensation depends on the value of the lost items and the length of the delay in returning the baggage.

Why Choose Skycop for Your ANAC 400 Claim?
Claiming flight compensation from airlines can be frustrating and time-consuming. That is where Skycop comes in.
If you are on a flight that has been overbooked, the airline will look for volunteers willing to give up their seat. These passengers must still be compensated - although the passenger and the airline are free to agree on the exact form the compensation takes.
If no volunteers are found, airlines may deny boarding to certain passengers. These passengers must be offered an alternative flight, appropriate care, and additional compensation. This compensation is set out under ANAC 400 and must be paid immediately.
| Compensation amount (£) | Compensation amount (SDR*) | |
|---|---|---|
| Domestic flights | Up to £260 (approximately) | SDR 250 (approximately £270) |
| International flights | Up to £520 (approximately) | SDR 500 (approximately £540) |
