What Is ANAC 400?

ANAC 400 is a regulation established by Brazil’s National Civil Aviation Agency (ANAC) to protect air passengers. It sets out passenger rights in Brazil when flights are delayed, cancelled or overbooked. The regulation ensures that passengers on both domestic and international flights receive fair treatment when airlines fail to provide an adequate service. However, some of these protections only apply when certain conditions are met.

History and the Regulation

The regulation was introduced in 2016 to provide clearer guidelines on flight compensation. Before ANAC 400, airline policies were inconsistent, and passengers often struggled to receive fair treatment. In addition, airlines could introduce policies that were generally disadvantageous to customers.

Passenger Rights Under ANAC 400

Under ANAC 400, passengers have clear rights when dealing with flight disruptions. Airlines must provide assistance and compensation depending on the length of the delay or whether an alternative flight is available.

  • Flight delays/
    If a flight delay exceeds 1 hour, airlines must provide access to communication. After 2 hours, they must offer food and drinks, or vouchers of equivalent value. After 4 hours, you are entitled to a refund, an alternative flight, or hotel accommodation if an overnight stay is required.

  • Flight cancellations
    If a flight is cancelled, passengers can choose between a refund, rescheduling, or rebooking on another airline. The airline must offer these options, and if it fails to do so, you may be entitled to claim flight compensation.

  • Denied boarding
    In cases of overbooked flights where no volunteers come forward to give up their seats, affected passengers must receive compensation and be offered an alternative flight as soon as possible.

  • Baggage issues
    If baggage is lost, delayed or damaged, passengers can submit a claim for reimbursement. The amount of compensation depends on the value of the lost items and the length of the delay in returning the baggage.

ANAC 400 Compensation Rules: Exceptions and Limitations

In general, the regulation offers strong protection, but there are certain exceptions where compensation does not apply:

  • Extraordinary circumstances. If a delay or flight cancellation occurs due to extraordinary circumstances such as adverse weather, security threats or airport strikes, airlines are not required to pay compensation.
  • Passenger fault. If a passenger fails to check in on time, they lose eligibility for any passenger rights under ANAC 400 in Brazil.
  • Timely information. If the airline informed you of any schedule changes at least 72 hours before the flight.
