Compensation Eligibility: When Can You Claim?
You may be eligible for compensation if your Tunisair flight departing from the UK was delayed by more than three hours, cancelled fewer than 14 days before departure, or if you were denied boarding due to overbooking. These situations are covered under UK Regulation 261/2004 (UK261), which applies when the disruption occurs on a flight leaving a UK airport.
However, compensation is only payable when the airline is responsible for the delay or cancellation. If the disruption was caused by extraordinary circumstances, compensation under UK261 usually does not apply.
Examples of situations where compensation is not payable include:
- Severe weather (such as snowstorms, strong winds or thunderstorms)
- Airport or security staff strikes (unless the strike involves the airline’s own crew)
- Air traffic control restrictions or congestion
- Political unrest or security risks
- Natural disasters, including volcanic ash or earthquakes
In some cases, Tunisair may offer an alternative flight. If this rerouting allows you to reach your destination with only a short delay, compensation may be reduced or may not apply at all.
