Passenger Rights Under ANAC 400
Under ANAC 400, passengers have clear rights when dealing with flight disruptions. Airlines must provide assistance and flight compensation based on how long a flight delay lasts or if an alternative flight is available.

Flight Delays /
If a flight delay exceeds 1 hour, airlines must provide communication access. After 2 hours, they must give you food and drinks or vouchers for their equivalents. After 4 hours, you can get a refund, another flight, or a hotel (if overnight). -
Flight Cancellations
Passengers can choose between a refund, rescheduling, or rebooking on another airline if a flight cancellation happens. The airline must offer these options, and if they don’t, you could apply for a flight compensation. -
Denied Boarding
In cases of overbooked flights and no volunteers to give up their seats, affected passengers must receive a flight compensation and be offered an alternative flight as soon as possible. -

ANAC 400 Compensation Rules: Exceptions and Limitations
Generally, the regulation provides generous protection, but there are some exceptions when compensation doesn’t apply:
- Extraordinary circumstances. If a delay or flight cancellation happens due to extraordinary circumstances such as bad weather, security threats, or airport strikes, airlines are not required to pay.
- Passenger’s fault. If a passenger fails to check in on time, they lose their eligibility to any ANAC 400 passenger rights in Brazil.
- Timely information. If the airline informed you 72 hours before the flight about any time changes.
Also, when the flight compensation reason is valid under ANAC 400, passengers must submit claims within:
- 5 years for domestic flights.
- 2 years for international flights.
