What Are The Regulations on Flight Cancellation Compensation?

Flight cancellation compensation under EU Regulation 261/2004 applies only to specific routes involving the European Union or the United Kingdom. For US passengers, this regulation applies if your flight departed from an EU airport on any airline, or arrived in the EU and was operated by an EU airline. It does not apply to US domestic flights or non EU international flights operated by non EU carriers.

For the purposes of an EU261 claim, a cancelled flight may entitle eligible passengers to fixed compensation amounts if the airline is responsible and the cancellation was announced within certain timeframes before departure.

In addition to compensation, passengers may choose between a full ticket refund or rebooking under EU261 rules, depending on the circumstances. Flight cancellation compensation can be one of the highest fixed payouts available under the regulation following a disrupted journey.

EC 261/2004 applies only to flights departing from an EU airport or to flights arriving in the EU operated by an EU  registered airline.

What Rights Do You Have in Case of Flight Cancellation?

Under EU 261/2004 passengers may receive compensation for a cancelled flight if the airline can reasonably be held responsible for the disruption.

Compensation is generally not payable if the cancellation was caused by extraordinary circumstances outside the airline’s control, such as severe weather or major air traffic control restrictions.

You may also be entitled to compensation for denied boarding due to overbooking if you were involuntarily denied boarding. If you voluntarily give up your seat in exchange for benefits, you may not be eligible for additional compensation later.

If you are unsure of your eligibility, Skycop can help determine whether compensation may be owed under EU law.

Eligibility to Claim Compensation for a Cancelled Flight

Cancelled Before Date of Travel

If your flight is cancelled 7 to 14 days before departure, your eligibility for compensation depends on whether a suitable alternative flight was offered. You may request rebooking on a similar schedule or choose a refund.

If your flight is cancelled more than 14 days before departure, compensation is generally not payable under EU261. However, you are typically entitled to a refund or rebooking.

If the cancellation affects connecting flights booked under the same reservation, additional reimbursement rights may apply under EU261.

Cancelled on the Day of Travel

Same day cancellations can be particularly disruptive. Speak with airline staff at the airport to understand your rebooking or refund options.

If you are offered compensation or benefits at the airport, review the terms carefully. Accepting certain offers could affect your eligibility for fixed compensation under EU261.

Keep detailed records to support your future claim, including:

  • Details of who you are traveling with.
  • Connecting flight documents.
  • Proof of booking and tickets.
  • Information provided about the reason for the cancellation.
  • Any written communication from airline staff.
  • Receipts for expenses caused by the cancellation.

Compensation amounts under EU261 are based on flight distance. In some cases, reasonable expenses for meals, accommodation, and transportation during the disruption may be reimbursed as part of the airline’s duty of care for covered flights. For US domestic flights, such assistance is typically provided according to airline policy rather than federal law.

When Do I Receive а Refunԁ for а Cаnсelleԁ Flight?

Your eligibility for compensation depends on how much advance notice you received and whether a suitable alternative flight was offered:

Notification before departure? Offered alternative flight? Right to compensation
Over 14 days N/A No
7-14 days Departs less than 2 hours earlier and arrives less than 4 hours later No
Under 7 days Departs less than 1 hour earlier and arrives less than 2 hours later No
Under 14 days No suitable alternative offered Yes

If no suitable alternative flight is provided and the cancellation falls within EU261 criteria, you may qualify for the following fixed amounts:

Flight distance is typically calculated using the Great Circle Method between departure and final destination.

or

How Long Are Flight Compensation Claims Valid?

Time limits for EU261 claims vary depending on the country responsible for enforcement. For example, in the United Kingdom, passengers generally have six years from the scheduled travel date to bring a claim under EU law.

Other EU countries apply different limitation periods based on local law. It is advisable to submit your claim as soon as possible after the cancellation.

In general, filing within 2 to 3 years of the scheduled travel date improves the likelihood of successful recovery, though longer periods may apply depending on jurisdiction.

Steps to Take If Your Flight Is Cancelled

If your flight is cancelled, remain calm and gather information to protect your rights.

  • Speak to airline staff.

Go to the airline’s service desk to ask about the reason for the cancellation and available rebooking or refund options.

  • Request written confirmation.

If the cancellation may qualify under EU261, ask for written confirmation of the reason for the disruption.

  • Save your documentation.

Keep tickets, boarding passes, booking confirmations, and receipts for meals, hotel stays, and transportation.

  • Ask for assistance.

For flights covered by EU261, airlines must provide meals, refreshments, accommodation when necessary, and rebooking or refunds. For US domestic flights, assistance is generally provided according to airline policy.

  • Check eligibility for flight cancellation compensation.

Review EU compensation rules to determine if your route qualifies. You may contact the airline directly or use Skycop’s services to assess your eligibility.

  • File a claim.

If eligible, submit your claim directly to the airline or request assistance from Skycop to manage the process.

Frequently Asked Questions

  • What documents do I need to get compensation for flight cancellations?

Provide booking confirmations, tickets, boarding passes, and details for all passengers in your group. Receipts for additional expenses and written communication from the airline can strengthen your claim.

  • How long do I have to claim flight compensation for a cancelled flight?

In the EU, claims may generally be brought within six years of the scheduled travel date. Other EU countries have different time limits. It is best to file as soon as possible.

  • Can I claim flight compensation if it was cancelled due to extraordinary circumstances?

In most cases, compensation is not payable if extraordinary circumstances caused the cancellation. However, for eligible EU261 flights, the airline still has a duty of care to provide assistance such as rebooking or refunds.

  • What should I do to claim flight compensation?

Keep supporting evidence such as tickets and receipts. Confirm that your flight qualifies under EU261 or EU261 rules, then submit a claim directly to the airline or use Skycop’s claim form.

  • Do I get compensation for a cancelled flight?

You may be eligible if the cancellation falls within EU Regulation 261/2004 and the airline was responsible. Compensation can reach up to $650 (€600) depending on flight distance. US domestic flights are not covered by EU261, and compensation rights are determined by US Department of Transportation rules and airline contracts of carriage.

  • Can I get a 100% refund on flight cancellation?

If your airline cancels a flight, you are generally entitled to a full refund of the unused ticket under EU261 for covered routes. In the United States, the Department of Transportation requires airlines to provide a refund if the airline cancels a flight and you choose not to travel. Additional compensation depends on the applicable regulation and circumstances of the cancellation.
