EU Regulation 261/2004 sets out compensation rights for passengers whose flights depart from the EU or arrive in the EU operated by an EU-registered airline. Emirates is a non-EU airline, so EU Regulation 261/2004 applies only to Emirates flights departing from the EU.
If your Emirates flight departed from the EU and arrived at your final destination more than 3 hours late due to reasons within the airline’s control, you may be eligible for compensation under EU Regulation 261/2004.
If you are denied boarding due to overbooking on an eligible EU departure, you may also be entitled to compensation under EU Regulation 261/2004.
If your delay exceeds 5 hours on an eligible EU departure, you may choose not to travel and request a refund of the unused ticket portion. For US routes, refunds apply to cancellations or significant schedule changes if you decline travel.
Schedule Change
Emirates may change the schedule of your flight. Under EU Regulation 261/2004, if your Emirates flight departing from the EU is cancelled or significantly changed less than 14 days before departure and no suitable alternative is offered, you may be eligible for compensation.
For US domestic flights, there is no fixed cash compensation for schedule changes, but you may request a refund if the change is significant and you choose not to travel.
